12. Applicable Law and Jurisdiction

12.2 Jurisdiction and Dispute Resolution

Primary Jurisdiction: For any dispute arising from the interpretation or performance of these Terms, the parties expressly submit to the jurisdiction and competence of the competent courts of the Mexican Republic.

Alternative Dispute Resolution: Before resorting to litigation, the parties agree to attempt resolution through:

Direct negotiation in good faith
Mediation through a recognized alternative dispute resolution institution

12.3 Local Consumer Rights

Important for International Users: Notwithstanding the above, nothing in this clause shall limit:

Rights available to consumers under applicable consumer protection legislation in your jurisdiction
Rights of users located in jurisdictions that provide additional non-waivable protections
Bethics’ obligations under applicable international treaties
Your right to bring proceedings in the courts of your country of residence where such right exists under local law

12.4 EU Users – Special Provisions

13. Dispute Resolution

13.1 Negotiation

13.2 Mediation

If direct negotiation is unsuccessful, the parties may agree to submit the dispute to mediation before a recognized alternative dispute resolution institution.

14. General Provisions

14.1 Severability

If any provision of these Terms is declared invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.

14.2 Waiver

The failure of Bethics to exercise any right or remedy under these Terms shall not constitute a waiver of such right or remedy.

14.3 Entire Agreement

These Terms and Conditions, together with the Privacy Policy, constitute the complete agreement between the parties regarding use of the Site.

14.4 Assignment

You may not assign your rights or obligations under these Terms without prior written consent from Bethics. Bethics may freely assign its rights and obligations.

14.5 Survival

Provisions that by their nature should survive termination of these Terms (including but not limited to those related to intellectual property, liability limitation, indemnification, and applicable law) shall continue in effect after termination.

14.6 Force Majeure

Bethics shall not be liable for non-performance of its obligations when such non-performance results from acts of God or force majeure, including but not limited to: natural disasters, acts of war, terrorism, pandemics, failures of essential third-party services, internet service interruptions, or any other circumstances beyond Bethics’ reasonable control.

14.7 Regulatory Compliance

Bethics is committed to complying with all applicable laws and regulations, including but not limited to:

Mexican Federal Law on Protection of Personal Data Held by Private Parties
General Data Protection Regulation (GDPR) for EU users
California Consumer Privacy Act (CCPA) for California users
Other applicable consumer protection and privacy laws

14.8 Language

These Terms are provided in English for the convenience of international users. In case of conflict between different language versions, the Spanish version published on www.bethics.mx shall prevail for matters governed by Mexican law.
